Crime as defined by Austin is an act or omission which the law punishes. Crime is not a private wrong, it is a wrong against the society at large. Criminal liability can be explained by the maxim Actus non facit reum nisi mens sit rea. i.e an act does not constitute guilt unless done with a guilty mind. The basic elements for a crime to take place are human being- the first element which is required for a wrongful act is to be committed by a human being. mens rea- means evil intention or a guilty mind. A crime cannot take place without mens rea or an evil mind. actus reus- means a criminal act which is the result of the voluntary bodily movement. It describes a physical activity that harms another person or property and injury- means an injury to another person or to the society at large is also an element of a crime. The injury should be illegally caused to any person, in body, mind, reputation or property.
